Enrolment

1.1 Given that we have a limited capacity for enrolment, enrolment is to be determined on a first-in, first-served basis. In the instance that competing enrollment takes place on the same day, the time of receipt of a deposit will be taken into consideration in determining the enrollment status of any person.

The first deposit of AU$ 2,500.00 is due on registration.

The second payment of AU$2,500.00 is due on or before1 June 2025.

The final payment of AU$ balance is due on 1 August 2025.

2. Fee

2.1 The price for the course is contained on the website.

2.2 The fee covers the following expenses if indicated:

a) tuition

b) any studio hire

d) vehicle hire for any private tour

e) walking tours

f) welcome dinner

g) farewell dinner

h) entry to and tour of specified establishments

i) public transport as specified

j) transfers between accomodations

 

2.3 The fee does not cover the following expenses unless indicated in the itinerary:

a) travel to and from destination

b) accommodation.

c) your art materials

d) food; and

e) any other expense which might reasonably be connected to this course, your participation in this course, or otherwise connected to travelling overseas, unless explicitly included in clause 2.2.

2.4 If any government imposes a duty, tax, or fee on the services provided under these terms and conditions, and such duty, tax or fee is not otherwise provided for in the amount payable under the tuition fee, you agree to pay any such amount, if and, when we request such payment.

2.5 Upon receipt of our request for payment you agree to pay us, promptly and by the terms specified herein, the tuition fee as stipulated in our registration letter.

2.6 Payment is to be made via the method specified in our registration link.  

 

3. Cancellations

3.1 We make every attempt to ensure that courses run, however, we reserve the right to alter any arrangements, including cancellation of courses if required. We will notify you as soon as possible of any cancellation. We reserve the right to cancel the course if minimum enrolment numbers are not attained.

4. Refunds

4.1 Requests made for refunds:

a) a refund, less $110 administration fee, will be given if requested in writing is made before 1 June 2023.

b) a partial refund will be given, if requested in writing, if made after 1 June 2025 but before 1 July 2025, noting that a refund request made within this period will attract a fee of AUD $900 to cover committed costs.

c) no refund will be given if the request for a refund is made after 1 September 2025, unless:

i) the course is cancelled by us; or

ii) another person is found to take your place, less $110 administration fee.

4.2 No refund, pro rata or otherwise, will be given for partial attendance, nor will make-up lessons be provided.

4.3 Refunds will be paid after the workshop.

4.4 We are not responsible for failure to fulfil our obligations due to causes beyond our control (β€œForce Majeure Event”) or where this course is frustrated by any Force Majeure Event.

a) Subject to satisfying the above definition, a Force Majeure Event may include but is not limited to, any of the following events: an act of God, casualty, or accident, lack or failure of transportation facilities, strike, lock-out, riot, war, terrorism, fire, flood, explosion, and pandemic (including those subsisting at the time of entering into the contract).

b) If a force majeure event prevents us from running the course at or during the scheduled timeframe, either party may terminate the contract by giving notice to the other.

c) In case of such termination, you are not entitled to a refund [unless we otherwise agree].

5. Indemnity in respect of costs arising due to cancellation

5.1 While we do everything to ensure that courses run, it is inevitable that occasionally courses are cancelled at late notice. Please be aware that, in such an instance, this clause operates to indemnify us from any travel-related costs, or other costs, that may reasonably be incurred due to cancellations.

5.2 You acknowledge that any cost arising in relation to a cancellation and associated costs are to be borne by you. Travel bookings must be made with this in mind. Before booking travel, please contact us to check the status of the workshop to assist with this process.

6. Pandemic

6.1 This course will be conducted in open and enclosed spaces; this includes in public settings.

6.2 It is advisable that you are up to date with all your vaccinations.

6.3 Covid-19 is a present danger, and the possibility of contracting such must be considered when planning any overseas travel.

6.4 Under these terms, you acknowledge that Tracey Miller Art owes no duty to safeguard or protect you from contracting Covid-19, or any other disease. You are solely responsible for your own health and well-being and indemnify Tracey Miller Art for any costs that might arise should you contract Covid-19 or any other disease while undertaking this course. 

7. Non-Attendance

7.1 Non-attendance of registered participants who have not contacted us to arrange for withdrawal prior to the start of the course will forfeit the full workshop registration fee.

7.2 Please refer to clause 4 above for further detail on the availability, if any, of a refund and relevant time periods to be complied with.

8. Quality Assurance

8.1 We provide the following warranties that replace all other conditions and warranties that may otherwise be applied, except those unlawful to exclude:

a) We warrant that we will employ people with the appropriate skills, as we determine, to teach the courses and tours scheduled.

8.2 By submitting the registration form you agree to the following:

a) I agree to abide by the workshop rules which include, without limitation, those rules set out in any literature provided by the workshop instructors and verbally, or other written instructions provided by the workshop instructors. I acknowledge that some of the rules are borne out of safety considerations.

b) I agree that I will obtain travel insurance to cover my travel to and from the workshop, in Italy. I agree to provide my travel insurance details to the workshop instructors upon request and acknowledge that the workshop instructors can exclude me from participation in the workshop should I fail to do so. In the event that I am so excluded I agree that I will not be entitled a refund.

c) I agree to participate in the workshop at my own risk. I understand that although the workshop coordinators attempt to minimise any risk of personal injury within practical boundaries, accidents do happen and all physical activities, especially those conducted in another country, carry the risk of personal injury.

d) In the case of an emergency, I authorise Tracey Miller Art workshop instructors to arrange for me to receive such medical treatment as may be deemed necessary. I also undertake to pay or reimburse costs which may be incurred for medical attention, ambulance transport and drugs, should this not be covered by insurance, while I am participating in all activities while at the workshop.

9. Liability

9.1 Circumstances may arise where, because of a default on our part or other liability (including negligence), you are entitled to recover damages from us.

9.2 To the extent permitted by law, in each such instance we are liable only for the charges for the course that is subject to the claim.

9.3 Under no circumstances are we liable for any special, consequential, or indirect damages, loss or profits, loss or revenue or goodwill or third-party claims, even if we are informed of their possibility.

10. Indemnity

10.1 Except where a claim arises as a result of our negligence, you agree to indemnify and keep indemnified Tracey Miller Art and the workshop instructor from and against all actions, proceedings, claims, demands, liabilities, costs and expenses arising (whether in contract or otherwise) from, or as a result of, your attendance at the workshop and/or participation in any activity.

11. Tracey Miller Art Privacy Policy

11.1 Your personal details will be used for the purpose of communication with you only, and not for any other purpose nor will they be given to anyone outside Tracey Miller Art.  

11.2 You can access your information for verification purposes on request.

12. General

12.1 We may modify these terms on written notice.

12.2 The terms as modified at the date of your enrolment or order will apply unless you cancel such enrolment or order prior to the effective date.

12.3 Otherwise, for a change to be valid, it must be agreed by both parties inwriting.

12.4 In the event that any provision of this agreement is held to be invalid or unenforceable, the remaining provisions of this agreement remain in full force and effect.

12.5 This agreement is made under and shall be interpreted in accordance with the laws of New South Wales.

12.6 Should any issue arise in relation to the terms and conditions contained herein, the jurisdiction for determination on any such issue is New South Wales.
